Rental Agreement, Rules and Regulations - All Properties
1. Rental Agreement. This Rental Agreement, Rules and Regulations (“Rental Agreement”) for each of the properties owned by Salty Vibes and/or Shawn and Linda Tidwell, as applicable: (a) Azure 222; (b) Destin West Heron 408; (c) Destin West, Heron 508; (d) Destin West Gulfside G204; and/or (e) Pelican Beach Resort 814, shall constitute an agreement between the renter of the condo unit and all their guests (the “Guests”) and Salty Vibes Beach Rentals, LLC, Salty Vibes Properties, LLC (“Salty Vibes”), and by renting the condo, the Guest agrees to all the terms and conditions set forth in this Agreement as well as all of the rules and regulations of Azure Beach Resort, Destin West Beach and Bay Resort and/or Pelican Beach resort as applicable.
2. Check-in/Check-out times. Guests may check-in any time after 4:00 Central Time. Check-out must be by 10:00 am Central Time on the day of check out to allow us time to have the unit cleaned and ready for the next guests.
Guests will receive a code from Salty Vibes prior to check-in to be used to get into the unit during the Guests entire stay. The code will activate at 4:00 on the day of check-in and deactivate at 10:00 am on the day of check-out. No actual check in is required at any of the Destin West condos or at Azure, simply head to the condo unit and enter the code.
For Azure: Guests will also receive 1 additional code prior to check-in to be used to access the Azure garage, lobby doors (for after hours) and fitness center.
For Pelican Beach: Guests will need to check in at the front desk in the lobby for wrist bands and a parking pass and to sign the Pelican Beach Rules and Regulations.
3. Deposit/Cancellation.
a. Direct Booking. 100% of the total amount is due at the time of booking. Guests may cancel any time prior to 21 days before check-in and receive a full refund. After the 21-day period, you may cancel but will only receive a return of 50% of the amounts actually paid. If a cancellation is within 7 days of check in, no refund will be applicable and Salty Vibes shall be entitled to retain the full amount of the rental.
b. Airbnb/VRBO. If you book through Airbnb or VRBO, their cancellation polices will apply.
4. Payments. Payment for direct bookings on our website may be paid by Stripe.
5. No Smoking. There is absolutely no smoking or vaping of any kind permitted in the unit or on the balcony. A fine of $250 will be imposed for violating the no smoking policy. We simply will not tolerate any smoking or vaping in the condo or on the balcony. In addition to the fine, you will be required to immediately vacate the premises and not receive any refund for your remaining stay.
6. No Pets. We love our pets and yours, but pets are not permitted pursuant to the Azure Beach Resort rules, the Destin West rules and the rules for Pelican Beach. A $250 fine for extra cleaning will be charged for violating the No Pets Policy. In addition to the fine, you will be required to immediately vacate the premises and not receive any refund for your remaining stay.
7. Parking. First come free parking is available on the premises. Please make sure to send us your e-mail address, so we can e-mail you a parking pass prior to the beginning of your stay. This pass must be displayed on your dash at all times. Salty Vibes is not responsible for any costs associated with the failure to properly display the parking pass on all vehicles at all times. At Azure and Destin West, we keep extra parking passes in the condo in care you forget to print one out. At Pelican Beach you get parking passes at the front desk in the lobby.
8. Wrist Bands. For Azure and Destin West, your unit has 8 wrist bands that must be worn in order to use the amenities. Please return the wrist band at the conclusion of your stay. Guests will be charged $20 per wristband that is not returned at the end of the stay. If you arrive and do not have 8 wrist bands please let us know. At pelican beach, disposable wrist bands must be obtained at the front desk in the lobby at check in.
9. Use: Use of any of our condo units shall be used so as to comply with state, county and municipal laws and ordinances. Guests shall not use rental or permit it to be used for any disorderly or unlawful purpose in any matter so as to interfere with other resident’s quite enjoyment of their residence. Any misuse described above shall result in termination of Rental Agreement and no refund of any payments will be issued. Quite hours are between 11 pm and 7am. In addition, at no time may loud music be played from the balcony.
10. Right of Access to the Unit: Salty Vibes and/or management of the applicable resort, shall have the right of access to the rental for repair and maintenance during reasonable hours. Salty Vibes will make every effort to minimize any disruption of your vacation!
11. Damage. Guests will be responsible for the payment of any damages made to the unit, any personal property in the unit, or the common areas upon demand.
12. Hurricane Policy. If the Applicable Resort is under a mandatory evacuation order, you agree to evacuate in accordance with directive, and will receive a refund for the remaining portion of your stay.
13. Age Requirements. No condo unit will be rented to anyone under the age of 25 years old unless accompanied by a parent or guardian throughout the stay. We do not permit a parent or other person over 25 to rent any of our units to those under 25.
14. Maximum Occupancy – Azure and Destin West.
The maximum number of guests at Destin West and Azure permitted in the condo units is 8. We are unable to make any exceptions to this policy.
15. Maximum Occupancy – Pelican Beach Resort.
The maximum number of guests at the Pelican Beach Unit 814 permitted in the condo units is 6. We are unable to make any exceptions to this policy.
16. Minimum Stay. Unless we agree otherwise, the minimum stay in our units is 3 nights and may be more during the spring, summer, or other peak travel times. We do not permit one night stays.
17. No daily maid-Service. There is no daily maid service. Your unit will be cleaned and ready to go when you arrive. We have a washer and dryer in each unit and a dishwasher. We have also provided towels, extra linens, pillows and blankets.
18. Beach Supplies. We have portable beach chairs, boogie boards, a beach cart and other items for your use. Please make sure to wash the sand off and return these items to the balcony so that other guests may use them as well.
19. No parties. We want our guests to enjoy the resort and our condos, but no parties or large groups are permitted. In addition, loud music may not be played on the balcony of any unit at any time.
20. Personal Items. We will not be held responsible for acts of theft or vandalism or other damages to the guest’s personal items left in the unit. Neither Salty Vibes, Azure Beach Resort, Destin West Beach and Bay Resort, Pelican Beach Resort nor the owner of the property is responsible for personal items left in the unit by guests upon departure. Please call in a timely manner if you have left something behind so that we may do our best to retrieve it for you and make arrangements to get it to you.
21. Resort Rules and Regulations. In addition to this Rental Agreement, all Guests agree to abide by all of the rules and regulations of the Azure Beach Resort, Pelican Beach Resort and/or Destin West Beach and Bay Resort as applicable, and do hereby indemnity Salty Vibes against any and all damages made by the Guests or their guests.
22.Violation of these Rules or the Resort Rules and Regulations. Any violation of this Rental agreement may result in eviction from the premises and forfeiture of all rent payments. Notwithstanding the foregoing, Salty Vibes reserve all rights and remedies against all guests.
23. Falsified Reservations. Any reservation obtained under false pretense, including, without limitation, renting the condo for anyone under 25 years of age, will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.
24. Liability: The guest acknowledges that Salty Vibes, Azure, Destin West, Pelican Beach, management, their owners, contractors and employees cannot be held responsible regardless of fault, for any sickness, accident, loss, damage or injury suffered by the Guests, members of their party or any other guests which the renter or their party have allowed access to the property, regardless if loss is a result directly or indirectly from acts of God, dangers incident to the sea, any body of water, fire, breakdown of machinery, equipment, acts of government or other authorities, delays or cancellations of or changes to itineraries or schedule or from acts of omission. Furthermore, the renter will release and hold harmless Salty Vibes and any and all parties involved with the rental, management, and reservations of the property and to release and hold harmless it’s owners or representatives for any loss or damage to personal property or for any injury and/or death. **The renter also acknowledges, that Salty Vibes, Azure, Destin West, Pelican Beach management, property owners and their contractors employees cannot be held responsible for any sickness, virus or illness that occurs during or after you stay at our property.
In addition to the indemnification provided above, the Guests releases Salty Vibes, their owners and contractors and Azure, Destin West and/or Pelican Beach Management from any and all liability for, and agrees to defend and indemnify each and/or all of them against any and all losses, incurred as a result of (a) Renter’s failure to fulfill any condition of this agreement; (b) any sickness, damage or injury happening in or about rental or premises of renter’s invitees or licensees or such person’s property; (c) Renter’s failure to comply with any requirements imposed by any governmental authority; and (d) any judgment, lien or other encumbrance filed against renter as a result of renter’s action.
25. Agreement Between the Guest and Salty Vibes. By making and keeping a reservation, Guest does hereby agree to be bound by the terms and conditions of this agreement and these rules and regulations. In the event the guest does not agree to these terms, the guest should immediately cancel the reservation.
